Section 46 of Indian Evidence Act in Hindi and English

46. विशेषज्ञों की रायों से संबंधित तथ्य -- वे तथ्य, जो अन्यथा सुसंगत नहीं हैं, सुसंगत होते हैं, यदि वे विशेषज्ञों की रायों का समर्थन करते हों या उनसे असंगत हों जबकि ऐसी रायें सुसंगत हों।

दृष्टांत

(क) प्रश्न यह है कि क्या क को अमुक विष दिया गया था।

यह तथ्य सुसंगत है कि अन्य व्यक्तियों में भी, जिन्हें वह विष दिया गया था, अमुक लक्षण प्रकट हुए थे, जिनका उस विष के लक्षण होना विशेषज्ञ प्रतिज्ञात या प्रत्याख्यात करते हैं।

(ख) प्रश्न यह है कि क्या किसी बंदरगाह में कोई बाधा अमुक समुद्र-भित्ति से कारित हुई है।

यह तथ्य सुसंगत है कि अन्य बंदरगाह, जो अन्य दृष्टियों से वैसे ही स्थित थे, किन्तु जहां ऐसी समुद्र भित्तियां नहीं थीं, लगभग उसी समय बाधित होने लगे थे।

46. Facts bearing upon opinions of experts -- Facts, not otherwise relevant, are relevant if they support or are inconsistent with the opinions of experts, when such opinions are relevant.

Illustration

(a) The question is, whether A was poisoned by a certain poison.

The fact that other persons, who were poisoned by that poison, exhibited certain symptoms which experts affirm or deny to be the symptoms of that poison, is relevant.

(b) The question is, whether an obstruction to a harbor is caused by a certain sea wall.

The fact that other harbors similarly situated in other respects, but where there were no such sea-walls, began to be obstructed at about the same time, is relevant.
