उत्प्रेरणा, धमकी या वचन द्वारा कराई गई 

संस्वीकृति दाण्डिक कार्यवाही में कब विसंगत होती है

 उत्प्रेरणा, धमकी या वचन द्वारा कराई गई संस्वीकृति दाण्डिक कार्यवाही में कब विसंगत होती है -- अभियुक्त व्यक्ति द्वारा की गई संस्वीकृति दाण्डिक कार्यवाही में विसंगत होती है, यदि उसके किए जाने के बारे में न्यायालय को प्रतीत होता हो कि अभियुक्त व्यक्ति के विरुद्ध आरोप के बारे में वह ऐसी उत्प्रेरणा, धमकी या वचन द्वारा कराई गई है जो प्राधिकारवान् व्यक्ति की ओर से दिया गया है और जो न्यायालय की राय में इसके लिए पर्याप्त हो कि वह अभियुक्त व्यक्ति को यह अनुमान करने के लिए उसे युक्तियुक्त प्रतीत होने वाले आधार देती है कि उसके करने से वह अपने विरुद्ध कार्यवाहियों के बारे में ऐहिक रूप का कोई फायदा उठाएगा या ऐहिक रूप की किसी बुराई का परिवर्जन कर लेगा।

 Confession caused by inducement, threat, or promise 

when irrelevant in criminal proceeding -- 

A confession made by an accused person is irrelevant in a criminal proceeding if the making of the confession appears to the Court to have been caused by any inducement, threat, or promise, having reference to the charge against the accused person, proceeding from a person in authority and sufficient, in the opinion of the Court, to give the accused person grounds, which would appear to him reasonable, for supposing that by making it he would gain any advantage or avoid any evil of a temporal nature in reference to the proceedings against him.
